CANCELLATION POLICY

This policy outlines your legal rights regarding the return of goods. To ensure full transparency and alignment with 2026 Consumer Protection Standards, we have updated these terms to reflect current regulatory requirements.

1. RIGHT OF WITHDRAWAL (CANCELLATION)

1.1. Statutory Right

You have the right to withdraw from this contract within 14 (fourteen) days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party designated by you (other than the carrier), acquires physical possession of the last goods in your order.

1.2. Exercising Your Right

To exercise your right of withdrawal, you must inform us of your decision by means of a clear declaration (e.g., a letter sent by post or an email).

You may use the Model Withdrawal Form (found at the bottom of this page), but it is not mandatory. To meet the deadline, it is sufficient for you to send your communication regarding the exercise of your right of withdrawal before the 14-day period has expired.

2. CONSEQUENCES OF WITHDRAWAL

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a non-standard, more expensive delivery method), without undue delay and no later than 14 days from the day we receive your notification of withdrawal.

  • Refund Method: We will use the same payment method used for the original transaction unless expressly agreed otherwise. You will not incur any fees for this reimbursement.
  • Right of Retention: We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent the goods back, whichever is the earliest.
  • Return Deadline: You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send the goods before the 14-day period has expired.

3. RETURN INSTRUCTIONS & RMA PROCESS

To ensure a smooth and efficient return process, please follow these steps strictly:

Step 1: Notification & RMA
Before sending any item back, please contact us via email at contact@art-paint.shop. Our customer service team will provide you with a Return Merchandise Authorization (RMA) number and specific shipping instructions.

Step 2: Condition of Goods
To be eligible for a return, your item must be unused and in the same condition that you received it. It must be returned in the original packaging.

  • Sealing: For paints, mediums, and chemical products, the goods must be returned in the original sealed (unopened) packaging.
  • Liability: You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Step 3: Packaging, Labelling & Return Costs
Please mark the package clearly on the outside with the phrase: “Art Paint – Return”. Send the goods to the following address no later than 14 days from the day you informed us of your withdrawal:

  • Return Shipping Costs: The direct costs of returning the goods must be borne by the customer. Original shipping costs are non-refundable.
  • Non-Postal Goods: For goods that, due to their nature (e.g., oversized palettes or bulk liquids), cannot normally be returned by regular post, the specific return shipping costs and arrangements are to be provided upon request.

4. REFUNDS

4.1. Processing Time

Upon receipt and inspection of your return, we will notify you via email regarding the approval or rejection of your refund. If approved, the refund will be processed and automatically applied to your original method of payment within 14 days of our receipt of the returned goods (or valid proof of postage).

4.2. Late or Missing Refunds

If you have not yet received your refund, please follow these steps:

  • Check your bank account again.
  • Contact your credit card company (official posting can take some time).
  • Contact your bank (processing times may vary).
  • If you have completed these steps and still have not received your refund, please contact us immediately at contact@art-paint.shop.

4.3. Sale Items

The statutory right of withdrawal applies equally to discounted goods ("Sale Items"). You may return these items within the 14-day withdrawal period for a full refund, provided they meet the return conditions outlined above (unused, original packaging, etc.).

5. EXCLUSIONS (NON-RETURNABLE ITEMS)

The statutory right of withdrawal does not apply to, or ceases to exist for, the following categories of goods:

  • Hygiene & Health Protection: Sealed goods (such as paints, solvents, mediums, or binders) which are not suitable for return due to health protection or hygiene reasons if they have been unsealed after delivery.
  • Customization: Goods that are not prefabricated and are manufactured according to customer specifications or are clearly tailored to personal needs (e.g., custom-mixed paint colors or cut-to-size canvases).
  • Perishables: Goods that are liable to deteriorate or expire rapidly.
  • Mixtures: Goods that have been inseparably mixed with other goods after delivery due to their nature.
  • Gift Cards: Gift cards are non-returnable and cannot be exchanged for cash.
  • Damaged or Incomplete Items: Any item not in its original condition, is damaged, or is missing parts for reasons not due to our error.
  • Late Returns: Any item returned after the expiration of the 14-day statutory withdrawal period.

6. EXCHANGES, GIFTS & DAMAGES

6.1. Exchanges

We only replace items if they are defective or damaged. If you need to exchange a defective item for the same product, please send us an email at contact@art-paint.shop.

6.2. Transport Damage

If you discover visible damage to the goods upon delivery, we strongly recommend that you have the damage confirmed in writing (e.g., a "Report of Damages") by the courier immediately upon receipt. While this is not a mandatory prerequisite for exercising your statutory warranty rights, doing so greatly assists us in processing your claim against the carrier efficiently.

6.3. Gifts

  • Marked as Gift: If the item was marked as a gift when purchased and shipped directly to you, you will receive a gift credit for the value of your return. Once the returned item is received, a digital gift certificate will be mailed to you.
  • Not Marked as Gift: If the item was not marked as a gift when purchased, or if the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver, and they will be notified of your return.
