SHIPPING & DELIVERY POLICY

1. GENERAL INFORMATION & PRICES

1.1. Product Prices

All product prices listed in our online shop are final prices in Euros (€). They include the statutory German Value Added Tax (VAT) and all other price components, unless explicitly stated otherwise.

1.2. Dynamic Shipping Costs

Shipping costs are calculated specifically for your order and are communicated to you during the basket process. They are reconfirmed on the final order page before you complete the purchase.

  • VAT on Shipping: The quoted shipping costs include statutory VAT. Under German tax law, the VAT rate applied to shipping services depends on the nature of the goods purchased (e.g., the standard rate for paints vs. the reduced rate for books).
  • Adjustment Policy: Consequently, the final shipping cost can only be definitively calculated during the checkout process. Please note that the cost will never increase after the initial calculation in the basket; it will only be adjusted to your benefit (i.e., reduced) if a lower VAT rate applies to the specific contents of your cart.

2. DELIVERY AREA

We currently ship to addresses in the following countries:

Europe (EU/EEA & Neighbors):
Albania, Andorra, Armenia, Austria, Belgium, Bosnia, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Greenland, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Moldova, Malta, Monaco, Montenegro, Netherlands, North Macedonia, Norway, Poland, Portugal, Romania, San Marino, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Ukraine, United Kingdom and Vatican.

International (Rest of World):
Argentina, Australia, Bahrain, Brazil, Brunei, Canada, China, Hong Kong, India, Indonesia, Israel, Japan, Jordan, Kuwait, Malaysia, Mexico, New Zeeland, Oman, Qatar, Saudi Arabia, Singapore, South Korea, Taiwan, Turkey, United States (US), United Arab Emirates (UAE).

Delivery Restrictions:

  • Delivery Address: The goods will be delivered to the physical address indicated by the customer in the order.
  • No PO Boxes: Delivery to PO Box addresses (Postfach) is not possible.
  • Phone Number: Please always provide a valid telephone number during checkout. This is strictly required for carrier queries to ensure successful delivery.

3. SHIPPING COSTS & CUSTOMS

3.1. Domestic & EU Shipping

Shipping costs are generally calculated as a flat rate based on the destination country.

  • Heavy Goods Surcharge: Due to the high costs of transport and special packaging required for certain items (e.g., large canvases, easels, or bulk mediums), an additional fee may be charged per order. If this applies, it will be clearly noted on the respective product pages.

3.2. International Shipping (Non-EU)

For orders shipped to countries outside the European Union (e.g., United Kingdom, USA, Switzerland), please be aware of the following:

  • Customs Clearance: Shipments may be subject to import duties, taxes, and customs handling fees levied by the destination country.
  • Payment Responsibility: These costs are not included in our shipping prices. They are invoiced directly to you by the carrier or local customs authorities and must be paid by the customer to receive the goods.

4. DELIVERY TIMES & DISPATCH

4.1. Preparation Time

Orders are generally prepared and dispatched within 3-5 business days from the date of the order confirmation, subject to inventory availability.

  • Prepayment: In the case of dispatch against prepayment (Bank Transfer), the delivery period begins on the working day following your payment instruction to the bank.

4.2. Delivery Deadlines

The total delivery time depends on the shipping service provider and the destination country.

  • Deadline Compliance: A delivery deadline is considered met if the goods are dispatched by us before the deadline expires.
  • School Holidays: Please note that we will only make deliveries to schools during school holidays if you explicitly guarantee acceptance of the shipment in your order notes. Otherwise, delivery will be held and made immediately after school resumes.

4.3. Force Majeure & Delays

The delivery time is extended appropriately in the event of circumstances beyond our control, including but not limited to:

  • Work stoppages (e.g., strikes or lockouts).
  • Legal or official orders (e.g., import/export restrictions).
  • Force majeure events (e.g., pandemics, natural disasters).

We will inform you of the beginning and end of such obstacles as soon as possible. If we are not responsible for the delay, we are entitled to terminate the contract regarding the unfulfilled part.

4.4. Liability for Delay

If we are responsible for non-compliance with bindingly agreed deadlines (default), your claim for compensation for damage caused by delay is limited to a maximum of 5% of the invoice value of the affected deliveries.

  • Limitation: Liability is limited to typical and foreseeable damage.
  • Exceptions: This limitation does not apply if the delay is due to intent, gross negligence, or injury to life, limb, or health.

5. TRANSFER OF RISK

For Consumers (B2C): The risk of accidental loss or accidental deterioration of the goods is transferred to you upon receipt of the goods. This occurs legally as soon as you (the customer), or a third party designated by you other than the carrier, physically take possession of the goods.

Documentation: Each shipped order will be accompanied by a proof of purchase (tax receipt or tax invoice) and a specific replacement/return form to facilitate any necessary returns.

6. PAYMENT & PREPAYMENT

Deliveries to private individuals are generally made only against prepayment or immediate digital payment (e.g., Credit Card, PayPal, Apple Pay).

  • Shipping Costs: Shipping and packaging costs are always borne by the customer (unless a free shipping promotion applies) and will be invoiced accordingly.
  • Dispatch: Goods will only be dispatched once the full invoice amount (including shipping costs) has been credited to our account.

7. TRANSPORT DAMAGE & DEFECTS

7.1. Visible Transport Damage

If goods are delivered with obvious transport damage (e.g., crushed boxes or leaking fluids), please report such defects immediately to the delivery agent (courier) and contact us as soon as possible.

  • Important: Failure to make a complaint or contact us does not affect your statutory warranty rights. However, reporting the damage immediately helps us assert our own claims against the carrier or transport insurance.

7.2. Accuracy & Claims

We strive for perfection, but errors can occur. All claims relating to:

  • An inaccuracy in quantities,
  • An erroneous reference to the confirmed order, or
  • Obvious defects,

...should ideally be notified to our customer service by email at contact@art-paint.shop within two (2) working days from the date of receipt. While this timeframe is not a preclusive deadline for statutory warranty claims for consumers, prompt notification allows us to rectify the issue immediately.
